Perused the case diary.
The prosecution case is that while some other coaccused assaulted the principal victim and murdered him, another person was seriously injured by some of the coaccused. As per the statement of the injured victim made before the police, the present petitioner placed an active role in the assault, while the same is missing in her statement made before the learned Magistrate. However, her presence was noted in such statement. As per the statement of the de facto complainant who was also an eyewitness to the incident, the petitioner and others instigated the co-accused
to commit such crime while the principal victim was done to death. The other victim suffered severe injuries and her abdomen was exposed by such attack.
Considering the incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
