The petitioner prays for issuance of Excise licence.

In a similar matter being WPA 23928 of 2024 (Mili Mandol -vs- State of West Bengal & Ors.), it appears that the authority has not issued the licence as the petitioner could not submit clearance certificate regarding the Coastal Regulation Zone (CRZ). The proposed site from where the business will be run falls within CRZ. 3.

The petitioner, however, categorically denies that the site falls within CRZ and submits that the place from where the business is proposed to be run has been functional for the last nine years. 4.

As the petitioner has not been able to produce any document permitting running of the bar at the subject place, accordingly, the relief sought by the petitioner for grant of licence for running business at a place which falls within the restricted zone cannot be allowed by the Court. 5.

The writ petition fails and is hereby dismissed. 6.

Certified copy of this order, if applied for, shall be made available to the parties.
