The petitioner is aggrieved by the fact that he was allured and was deceptively sold a property which was earlier sold to a different person. At the relevant point of time, the accused/respondents did not have any authority and in spite of that, accepted a sum of Rs.19,00,000/-. The petitioner complained to the Officer-in-Charge, Panchla Police Station by way of a representation dated 11.09.2024.

A report has been submitted on behalf of the State which reflects that Panchla Police Station Case No. 323/2024 dated 21.09.2024 has been registered for investigation.

Learned advocate appearing for the private respondent nos. 5 and 6 submits that the private respondents have appeared before the learned trial court and has been released on bail.

The petitioner approached this Court at a stage when he was aggrieved that the police authorities refused to register any FIR. As primary grievance of the petitioner has been addressed, FIR has been registered and the jurisdictional court is in seisin of the matter, the petitioner is granted liberty to canvass rest of the issues regarding inaction of the police authorities before the jurisdictional Magistrate.

With the aforesaid observations, the writ petition being WPA 23807 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
