Status report of the case, as filed on behalf of the respondent bank, is also taken on record.

Learned counsel for the petitioner submits as follows. The petitioner is the borrower in question. He is an aged widow suffering from different ailments. A proceeding is pending under the SARFAESI Act, before the D.R.T. - III, Kolkata. However, the petitioner wants a one time settlement.

Learned counsel for the respondent bank denies the allegations and submits that a proceeding is already pending under the SARFAESI Act.

In view of the above, the D.R.T.- III, Kolkata is requested to expedite the proceeding and decide the matter giving some priority to it considering the peculiar circumstances and the advanced age of the petitioner.

The petitioner shall also be at liberty to make an interlocutory application with a put up or otherwise, which shall be entertained by the learned Tribunal.

With these observations the writ petition is disposed of.

As no affidavit called for, the allegations made are deemed not to have been admitted.
