Mr. Himadri Sekhar Chakraborty Mr. Arun Kumar Ghosh ...Advocates Affidavit of service filed by the petitioners and report submitted by the State are taken on record. The petitioners allege that the private respondent is restraining them from cultivating the land purchased by them. The petitioners lodged complaint before the police authority but to no effect. Learned counsel for the State submits that the dispute is civil in nature. The police has submitted a prosecution under Section 126 of the Bharatiya Nagarik Suraksha Sanhita, 2023 pursuant to the complaint lodged by the petitioners and has been ensuring that there is no breach of peace in the area.

The petitioners claim to be the owners of the land in question by virtue of purchase and allege that they are restrained by the private respondent from cultivating the same. The dispute between the parties is essentially civil in nature. The petitioners are at liberty to approach the appropriate forum for redressal of their grievance.

In the meantime, the police authority is directed to keep strict vigil in the area in order to avoid any untoward incident and to ensure peace and tranquility.

The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
