The instant criminal revisional application was filed against an order dated 26.08.2011 passed by the learned Additional Sessions Judge, Katwa in Criminal Revision No. 99 of 2010 under Section 37/398 of the Code of Criminal Procedure thereby modifying the order dated 09.08.2010 passed by the learned Additional Chief Judicial Magistrate, Katwa in Misc. Case No. 17 of 2005 under Section 127 of the Code of Criminal Procedure. Perused petition and the order under challenged passed by the learned Trial Court.

Under such circumstances, this court is not inclined to interfere with the impugned judgment and order which has been reasoned. The instant criminal revisional application is dismissed. Interim order if any stands vacated.

Copy of the order be sent to the Department as well as learned Trial Court for due compliance.
