2. Learned counsel for petitioner submits that the judgment of this Court passed in F.M.A.

241 of 2010 was unsuccessfully put to test by the Department before the Hon'ble Apex Court in Civil Appeal No(s).11308 of 2011.

The said civil appeal has been dismissed on 28th January, 2026.

3. Learned counsel for petitioner submits that if any legal dues are payable in favour of the legal representative because the petitioner/ employee has already died, an opportunity

may be given to the legal representative to file appropriate proceedings.

4. The other side has no objection.

5. The contempt petition is disposed of by reserving liberty, as prayed for.

6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
