05.02.2025 rc/ct.no.34 Item No.268 CRR No. 4102 of 2024 In the matter of : Mokhlesur Rahaman .......Petitioner Mr. Haradhan Mondal ...for the Petitioner A shocking state of affairs has been brought to the notice of this Court this day. FIR was lodged against the petitioner and another person on December 12, 1996 which was registered as G.R.Case No. 878 of 1996 and is still pending before the learned Additional Chief Judicial Magistrate, Basirhat. Since the petitioner seeks expeditious disposal of the case pending before the learned trial Court, the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case.

This Court is informed that charge sheet was submitted on December 15, 1998. The learned Additional Chief Judicial Magistrate, Basirhat committed the case to the learned Additional Sessions Judge, 3rd Court, Barasat but the said Court did not accept the file due to the delay on the part of the learned Additional Chief Judicial Magistrate, Basirhat in sending the same. The learned Additional Sessions Judge, 3rd Court, Barasat has called for an explanation with regard to the said delay. In the process, the trial is stalled and the petitioners as well as the opposite party are suffering.

In view of the above, the learned Additional Chief Judicial Magistrate, Basirhat is directed to commit the case record to the learned Additional Sessions Judge, 3rd Court, Barasat at the earliest in order to avoid further delay in disposal of the case in any event not later than two weeks from the date of communication of this order. The learned Additional Sessions Judge, 3rd Court, Barasat is directed to take the proceedings to its logical conclusion as expeditiously as possible, not later than six months, from the date of receipt of the case record, without granting any unnecessary adjournment to either of the parties, in accordance with law.

With the above observations and directions the instant revisional application being CRR No. 4102 of 2024 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
