ct.no.35 W.P.A.23907 of 2024 Rahul Chowdhury

Versus

State of West Bengal & Ors.

Ms. Atreyee Halder.

...for the petitioner.

Mr. Jayanta Samanta Mr. Kaji Sajjad Alam.

...for the State-respondents.

Petitioner is aggrieved by the mode, manner and progress of the investigation. Petitioner alleges that he is being threatened by the accused persons who have been released on bail and to that effect he has approached the appropriate court under the relevant provisions of law. Petitioner now complains that considering the nature of the injury complained of, the State has incorporated sections which are not commensurate with the injury sustained by the petitioner. The assessment regarding the sections would be considered at the final stage, but what is reflected from the report submitted by the State is that subsequently after registration of the case Sections 324/354/509 of the Indian Penal Code have been added.

If the petitioner is further aggrieved, petitioner would, at the appropriate stage after the

investigation is taken to its logical conclusion, canvass his grievance regarding the applicability of sections in respect of the foundational facts complained of or the materials surfacing in evidence. As directed above, let the investigation be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, WPA 23907 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted by the learned advocate for the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
