Heard learned counsels for the parties.

Learned counsel for the petitioner submits that despite an order of the learned trial Court restraining the private respondents from changing the nature and character of the land in question, they are raising unauthorized construction therein by encroaching upon the same in violation of the learned trial Court's order. Complaint lodged before the police has not been considered.

Learned counsel for the State submits that FIR has been registered pursuant to the complaint lodged by the petitioner and charge sheet has been submitted upon completion of investigation.

The dispute between the parties is civil in nature. In the event the petitioner alleges violation of the learned trial Court's order by the private respondents, he is at liberty to

approach the learned trial Court for redressal of his grievance. In the meantime, the police authority shall maintain strict vigil in the area in order to avoid any untoward incident since there appears to be strained relationship between the parties. The police authority shall also ensure maintenance of peace and tranquility. The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
