And In the matter of: Harun Al Rasid and others ...petitioners Mr. Tapodip Gupta ...for the petitioners Mr. Binay Kumar Panda, Ms. Pushipta Saha ...for the State Having heard the learned advocate for the petitioners and the learned Public Prosecutor-in-Charge and on perusal of the material on record, it is ascertained that commercial quantity of narcotic substance was recovered from the possession of the petitioners.

Charge-sheet has already been submitted.

Therefore, in view of the embargo under Section 37 of the N.D.P.S. Act, 1985, we are not inclined to release the petitioners on bail.

Since charge-sheet has already been submitted, the learned Special Judge is requested to frame charge within one month after reopening and proceed with the trial expeditiously. The instant application for bail being CRM (NDPS) 1258 of 2022 is thus rejected.
