1. Affidavit of service filed on behalf of the appellant is taken on record.

2. Mr. Laksminath Bhattacharya, learned counsel for the appellant submits that he may be permitted to withdraw this intra-court appeal with the liberty to file a fresh writ petition seeking relief of transfer of investigation to CID, because this prayer made by the petitioner was not dealt with by learned Single Judge.

3. Mr. Amal Kr. Sen, learned counsel for the State has objection to this innocuous prayer.

4. Accordingly, appeal and the application are permitted to be withdrawn with the liberty prayed for.

5. It is made clear that this court has not expressed any opinion on merits of the case.
