Ct.No.28 as (Rejected) C.R.M. (DB) 3744 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Penro P.S. Case No.120 of dated 30.10.2021 under Sections 302/201/212/34 of the Indian Penal Code.
In the matter of : Prem Singh @ Sonu.
... Petitioner.
Md. Habibur Rahaman, Mr. Maidul Islam Khayal, Mr. Sumit Naskar.
...for the Petitioner.
Mr. Prasun Kr. Dutta, ld. A.P.P., Ms. Puspita Saha.
...for the State.
Heard the learned Advocate for the petitioner. He submits his client is in custody for 370 days. Co-accused Manoj Singh had been granted bail.
Learned Advocate for the State opposes the prayer for bail. He submits petitioner does not stand on the same footing with co-accused Manoj Singh.
We have considered the materials on record. Petitioner was present at the place of occurrence when the victim was murdered. Manoj Singh is the father of the petitioner and he does not stand on the same footing with him.
Under such circumstances and in view of the gravity of the offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
