The petitioner alleges that the complaint lodged by her has not been registered as FIR by the police authority. Learned counsel for the State submits that upon preliminary enquiry with regard to the complaint lodged by the petitioner and on going through the video and audio recordings produced by her, the police authority did not find any material to proceed with the complaint and register the same as FIR.
On the other hand, learned counsel for the petitioner submits that there is sufficient material to substantiate the demand of bribe by the investigating officer and molestation of the petitioner.
In view of the law laid down by the Hon'ble Supreme Court in Aleque Padamsee & Ors. Vs. Union of India reported in (2007)6 SCC 171, the petitioner is at liberty to
approach the jurisdictional magistrate for redressal of her grievance.
The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
