Learned counsel appearing for the petitioner, however, points out that despite the specific order of this court dated November 26, 2019 to dispose of the dispute raised by the petitioner within three months from that date, a notice of hearing was given by the alleged contemnors as long thereafter as after about two years. It is submitted that the said act on the part of the Rajpur Sonarpur Municipality and the alleged contemnors was a patent and deliberate violation of the order of this court.

Moreover, till date, the outcome of the consideration has not been intimated to the petitioner by the alleged contemnors.

In view of the serious allegations made, keeping on balance the fact that the counsel for the alleged contemnors is ill today, the matter is adjourned only for the day and shall next be listed tomorrow (04.04.2023) under the same heading.

It is made clear that in the event the alleged contemnors remain unrepresented or pray for adjournment on the next date when it is called on for hearing, ex parte orders may be passed and/or Rule may be issued against the alleged contemnors. (Sabyasachi Bhattacharyya, J.)
