Heard Mr. Kamal Kumar Chattopadhyay, learned Counsel for the petitioner and Mr. Saswata Gopal Mukherjee, learned Public Prosecutor. It is submitted by Mr. Chattopadhyay that challenging the order of learned Additional Sessions Judge, 3rd Fast Track Court, Murshidabad, directing Sentu Mirza, Director of Nagar Samabay Krishi Unnayan Samiti to keep the seized rice in the Godown of FCI through "CONFEED" within three days at his own cost upon execution of bond of Rs. 1 crore. FCI filed this application under consideration. But the report of the District Magistrate and Collector, Murshidabad reveals that said Sentu Mirza disposed of the rice in question, without obtaining permission from the learned court that granted interim custody of rice to him. This factum of disposal of rice has made this application infructuous. Under such circumstances, I am inclined to dispose of the revisional application being

"infructuous". Interim order of stay, if any, stands vacated.

Learned Trial Court is directed to proceed with the GR Case No.1233 of 2006 according to law.
