The grievance of the petitioner is two-fold:- first, the suicide note which was found at the place of occurrence was not seized by the investigating officer by a seizure list. Second, the mobile phone seized from the petitioner has not been sent for forensic examination.
It appears from the report that the suicide note has been seized and sent to the Director of Questioned Documents Examination Bureau, CID, West Bengal along with specimen handwriting of the petitioner for examination.
Learned counsel for the State submits that the mobile phone shall be sent for forensic examination in course of investigation.
In view of the above, pendency of the writ petition shall not serve any fruitful purpose.
Accordingly, the writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
