The present revisional application has been preferred against the order dated 16.07.2011 passed by the learned Judicial Magistrate 3rd Court, Barrackpore, North 24 Parganas, in connection with the case No. 361 of 2010 under Section 125 of the Code of Criminal Procedure. The order passed by the learned Magistrate on 16.07.2011 reflects that the learned Magistrate being, prima facie, satisfied with the contention advanced by the wife/applicant was pleased to award interim maintenance to be paid by the petitioner/husband to the tune of Rs.3,000/- per month to the wife and Rs.1500/- per month to the minor child, aggregating to a sum of Rs.4,500/- per month.
Records of the revisional application reflect that the case appeared on 11.09.2012 before the Coordinate Bench of this Court but the same was adjourned. The revisional application till date has not been admitted and no information has been furnished regarding the present stage of the proceeding before the learned court below. Having regard to the order which have been passed by the learned Magistrate by way of interim measure during the pendency of the main application under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for at this stage.
Accordingly, CRR 3130 of 2012 is dismissed.
Pending application, if any is consequently disposed of.
