Salpa Ray Alias Salpa Srimani Ray v. State Of West Bengal And ORS.
28.11.2025 rc/ct.no.26 Item No.16 WPA No. 24031 of 2025 Salpa Ray alias Salpa Srimani Ray
Versus
The State of West Bengal & Ors.
Mr. Partha Pratim Singh Mr.Susnigdho Bhattacharyya ..for the Petitioner Mr. Kishore Mukherjee Mr. Ahiagni Dey ...for the respondent no.5 Mr. Anirudha Mohanta ....for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record.
Heard learned counsels for the parties.
Petitioner submits that her son who has attained majority has left her house and is not traceable. A diary lodged by the petitioner in this regard has not been acted upon.
It appears from the report submitted by the State and is also submitted by the learned counsel for the private respondent that the petitioner's son has voluntarily left her mother's house and has been residing with the private respondent who is his father. The said son has informed the Officer in Charge, Lake Town Police Station that he has left the house voluntarily since he is an adult and is competent to take his own decision. There appears
to be a matrimonial discord between the petitioner and the private respondent.
In view of the fact that the petitioner's son has voluntarily left the petitioner's house and does not want to disclose his present residential address, nothing further - remains to be dealt with in the writ petition. The same is accordingly disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
