The revisional application was preferred in respect of a proceeding being M.P. Case No.1074 of 2012 wherein the learned Executive Magistrate, 2nd Court, Hooghly by an order dated 03.08.2012 was pleased to admit the same and directed a restraint order upon the opposite parties and further called for a report of B.L. & L.R.O., Daspur.
Having regard to the provisions of Section 144 of the Code of Criminal Procedure, which has time constraints for its existence, I am of the view that that the main proceeding before the learned Executive Magistrate has become infructuous. Accordingly, CRR 3141 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
