Record of this revisional application reflects that the original case records of CRR 3142 of 2012 have been traced out by the Department and placed before this court along with the constructed case records of CRR 3142 of 2012. The revisional application was preferred challenging the proceedings pending before the learned Additional Chief Judicial Magistrate at Alipurduar which arose out of Kumargram Police Station Case No. 252 dated 15.11.2010 under Sections 420/406 of the Indian Penal Code.

Mr. De, learned advocate appearing for the petitioner submits that prima facie the allegations made in the F. I. R and the chargesheet so submitted do not make out any offence so far as the present petitioner is concerned. Mr. Arijit Ganguly, learned advocate appearing for the State opposes the said contention.

Having regard to the fact that the revisional application is pending since the year 2012 and as no interim order has been in respect of the proceedings pending before the court below, I am of the view that no interference can be made at this belated stage by this court.

Accordingly, the present revisional application being CRR 3142 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. However, the petitioner will be at liberty to take up the points canvassed in this revisional application at the appropriate stage of trial and also at the final argument of the case before the learned court below.
