Petitioner The petitioner is aggrieved by the order dated 19.8.2023 passed by the ld. ACJM, Kandi, Murshidabad in connection with Misc. Case No. 510 of 2022. By the said order the ld. Magistrate was pleased to award a sum of Rs.12,000/- as interim maintenance.

The petitioner is aggrieved by the quantum assessed by the ld. Magistrate for the purpose of interim maintenance.

Having regard to the issue so canvassed and the foundation on which the ld. Magistrate relied upon to arrive at this finding, I do not find, at this stage, any reason for modifying the said amount until and unless certain special circumstance are brought to the notice of the Court. Accordingly, if the petitioner prefers an application under Section 127 of the Cr.P.C. before the ld. ACJM, Kandi,

Murshidabad, assigning reasons, the ld. Magistrate would consider the same in accordance with law.

No interference is made by this Court at this stage. With the aforesaid observations, CRR 3735 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
