Mr. De, learned advocate appearing for the petitioner files an affidavit-in-exception to the report filed by the respondent Nos.3 and 4.

The petitioner has prayed for setting aside the eauction notice dated August 5, 2025 in this writ petition. However, during the pendency of this writ petition the work order has been issued to the successful bidder, who has been impleaded as the respondent No.7 in this writ petition.

In view of such subsequent events Mr. De, learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to file a

comprehensive writ petition on the selfsame cause of action as well as on the subsequent events.

Such prayer is vehemently opposed by Mr. Kar, learned senior advocate for the respondent No.3 to 5. However, in view of the subsequent events that took place, this Court is of the view that the issues raised in this writ petition can be adjudicated effectively if this writ petition is allowed to be withdrawn with liberty to the petitioner to file a comprehensive writ petition on the selfsame cause of action.

Accordingly, WPA 23562 of 2025 stands dismissed as withdrawn with liberty to the petitioner to file a comprehensive writ petition on the selfsame cause of action as well as on the subsequent events.

There will be no order as to costs.
