The learned advocate for the bank submits that proceedings have also been initiated by the petitioner before the learned Debts Recovery Tribunal challenging the SARFAESI proceedings. It is also submitted that a particular sale notice which has been challenged in this writ petition did not go through as there were no bidders. According to the learned advocate, this writ petition is not maintainable.

Upon recording such submission and as the petitioner is not before the court, let the matter be dismissed for default.
