Mr. Debayudh Ganguly, Mr. Surojit Saha ...for the petitioner This is an application wherein petitioner has prayed for expeditious disposal of the proceeding being Bidhannagar North Police Station Case No.162 of 2023, presently pending before the learned Additional Chief Judicial Magistrate, Bidhannagar. Since the prayer made on behalf of the petitioner is innocuous and if an order is passed in terms of the prayer made on behalf of the petitioner, other party will not be prejudiced, the service of copy of application upon the opposite party is dispensed with. Learned Counsel appearing on behalf of the petitioner submits that the instant case was initiated under Sections 420/406 of the IPC on the basis of a written complaint on 16.10.2023 and after completion of investigation police submitted charge-sheet on 29th February, 2024.

Learned Trial Court took cognizance of the offences on 15.03.2024 and next date was fixed on 22nd August, 2025 for the appearance of the accused persons. Since thereafter the accused person is evading appearance before the Court and that the Court is granting unnecessary adjournments one after another without taking appropriate steps against the absconding accused.

Having heard learned Counsel for the petitioner, I find that the prayer made on behalf of the petitioner is justified and is required to be allowed for the ends of justice.

Having heard learned Counsel for the petitioner, the instant application being CRR 4444 of 2025 is hereby disposed of with a direction upon the Trial Court to make best endeavour to expedite the hearing of the case being G.R. Case No.1100 o0f 2023 and to make his best effort to conclude the proceeding preferably within a period of six months from the next date of hearing.
