Mr. Samiran Mandal, Mr. Abhinaba Dan ... for the petitioners Mr. Kamal Kumar Chattopadhyay, Ms. Rimi Chatterjee . .. for the respondent/FCI Learned counsel for the respondent/ Food Corporation of India moves CAN 2 of 2024 stating that a settlement has been arrived at between the parties represented by their respective learned counsels on 22.8.2023 that is subsequent to the filing of the writ application.

At this stage the learned counsel for the petitioners submits that in view of the said settlement the petitioner is not willing to proceed with the writ application.

Learned counsel for the respondent/Food Corporation of India submits that necessary direction may be passed by this Court granting leave to

the respondent/FCI to post the remaining 7 (seven ) CCL labourers of Bikna depot in the Divisional Office of FCI at Bankura for doing the nature of class-IV type of job on the same terms and conditions as contained in the order dated 14th January, 2010, thus relieving them from the QC related job which are being done by them at the present moment in the Bikna Deport of FCI.

Learned counsel for the writ petitioners submits that this is not the relief prayed for in the writ application and the FCI cannot pray for such relief from the Court.

Admittedly, the transfer of the said Contract Casual Labours is not part of the settlement. It is further submitted by the learned counsel for the respondent/FCI that the transfer which the FCI wants to make is at a distance of only 3.9. kms. As such the petitioners will not be prejudiced in any manner whatsoever.

Considering the submission of the learned counsels for the parties, the writ application is disposed of on the ground of settlement arrived at between the parties.

The respondent/FCI is at liberty to proceed with all administrative actions,

necessary for the proper functioning of the Corporation in accordance with law.

CAN 2 of 2024 is also accordingly disposed of.

Urgent Photostat certified copy of this order, if applied for be given to the learned counsel for the parties on usual undertakings.
