Shibpur Police Station Case No. 37 dated 01.02.2022 was registered for investigation under Section 272/273/420/120B/34 of the Indian Penal Code. Mr. Gupta, learned Advocate, appearing for the petitioner submits that the Learned Magistrate, for a considerable period of time was calling for a report from the investigating officer. To that effect number of orders have been referred to by the learned Advocate appearing for the petitioners. Lastly, it was pointed out that the order dated 18.05.2023 also reflects that the learned Magistrate has fixed 16th November, 2023 (today) for I.O's report. In view of the investigation having commenced on February 2, 2022 and more than one year nine months have passed since then, I direct the Assistant Commissioner of Police, Enforcement Branch, Howrah Police Commissionerate to submit the report under Section 173 of the Code of Criminal Procedure along with the expert's report, if any, by 31st December, 2023 before the Learned Chief Judicial Magistrate, Howrah.

With the aforesaid observations, CRR No. 3737 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.
