Admittedly the house in question belonged to the father of the petitioner and the 7th respondent who are full blood brothers. The petitioner alleges that he was residing in the first floor of the property and was driven out therefrom by the 7th respondent who has been restraining him from entering the property. The dispute between the parties is civil in nature. The petitioner is at liberty to approach the appropriate forum for redressing his grievance. However, it appears from the report that the police authority has registered case under Section 170/126 of the BNSS and an amicable settlement appears to have been arrived at by and between the parties.
In view of the above, keeping the writ petition pending shall not serve any fruitful purpose.
The writ petition is accordingly disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
