Petitioner was aggrieved by the discharge of two of the accused persons from the charge-sheet, namely, Nimchand Mondal and Ramoni Mondal.

I have perused the case diary which has been produced by the learned advocate appearing for the State. Prima facie, I find that there is sufficient complicity in the materials already collected by the investigating agency against Nimchand Mondal and Ramoni Mondal, thereby calling for interference in respect of the prayer for discharge advanced by the investigating officer of the case.

The SDPO, Farrakka who is in charge of Suti Police Station will consider the materials and will direct the investigating officer of Suti Police Station Case No.420 of 2024 to submit the supplementary charge-sheet before the jurisdictional court incorporating the names of the discharged accused

persons in view of the materials existing already in the case diary.

With the aforesaid observations, WPA 23869 of 2024 is disposed of.

There will be no order as to costs.

Case diary be returned to the learned advocate appearing on behalf of the State.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
