1. By this application, the petitioner seeks expeditious disposal of Matrimonial Suit No.48 of 2021, which is pending before the learned Judge, Family Court, Jhargram.
2. It appears that an application for maintenance under Section 36 of the Special Marriage Act is pending disposal.
3. Considering the submissions, this Court is of the view that the prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties.
4. Under such circumstances, the revisional application is disposed of with a direction upon the learned court to dispose of the application under Section 36 of the Special Marriage Act as expeditiously as possible, preferably within a period of six months from the date of communication of this order. Thereafter, the learned court shall make a sincere endeavour to dispose of the suit expeditiously, provided the husband pays the maintenance, if allowed by the court, in accordance
with law. In case of default in payment or nonpayment, the suit shall not proceed. Adequate opportunity shall be given to the parties to contest the same.
5. This court has neither expressed any opinion on the merits of the application nor on the merits of the suit. The learned court shall proceed independently and in accordance with law.
6. The revisional application is accordingly disposed of.
7. There shall be no order as to costs.
