Case No. 07/2022 arising out of Golabari Police Station Case No. 06 of 2022 dated 06.01.2022 under Sections 27(A)/28/29/30 of the N.D.P.S. Act.

This is an application by one accused in N.D.P.S. case. They were apprehended from Golabari Police Station in the district of Howrah. From the cellular phone seized from the coaccused it was found that there were conversations of fifty eight times between the petitioner and the other accused, Md. Alfas Khan. The petitioner came from Imphal, Manipur and the air ticket is there in the case records and also the hotel register where they stayed including their PAN card and Aadhaar card and it is found that the name of the petitioner is there from whom the contraband was seized.

There is sufficient material against the petitioner and so he is unable to overcome the rigor of Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Prayer for bail is thus, rejected. There shall be custodial trial of the petitioner.

It has been submitted on behalf of the learned Public Prosecutor that the co-accused standing on the same footing moved bail application which has been rejected. Accordingly, the application being CRM (NDPS) 1271 of 2022 is dismissed.
