Since the petitioner seeks expeditious disposal of Misc. Cases being 317 of 2022 and 241 of 2022 pending before the learned Judicial Magistrate, 5th Court, Barrackpore the matter may be considered without service of notice upon the opposite parties.

The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. Learned counsel for the petitioner submits that the application under Section 23 of the Protection of Women from Domestic Violation Act has not been considered by the learned Trial Court till date.

In view of the above, the learned Trial Court is directed to consider and dispose of the application filed by the petitioner under Section 23 of the Act of 2005 on the next date of hearing fixed before him and pass a reasoned order within a month therefrom.

The learned Trial Court shall also dispose of the application under Section 12 of the Act as expeditiously as

possible without granting any unnecessary adjournment to either of the parties, in accordance with law. The revisional application being CRR 4118 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
