It is the petitioner's case that after the petitioner was brutally raped by the accused, the wife of the accused lodged a similar case of rape against the brother in law of the petitioner. It was contended by the petitioner that the Investigating Officer did not seize any wearing apparel of the victim and that the wife of the accused was made a witness in the petitioner's case.

After perusal of the case diary, it appears that the wearing apparel of the victim was indeed seized by the Investigating Officer.

From a copy of the charge-sheet, it does not even appear that the wife of the accused has been cited as a witness in the charge sheet.

A charge sheet has already been submitted after

completion of purported investigation.

Therefore, no further order need be passed in this regard.

In the event the petitioner is aggrieved with the outcome of the investigation, she shall be at liberty to file a protest petition before the learned trial Court. Considering the further apprehension of the petitioner regarding threats given to the victim, let the Officer-inCharge of Kaliganj Police Station keep a sharp vigil at the locale, ensure that no breach of breach of peace takes place and no harm is done to the petitioner or his family members. The surveillance would include frequent visits by police patrol in the area.

The writ petition is accordingly disposed of, albeit without any cost.
