And In the matter of: Kushi Chandra Biswas ....Applicant/Petitioner Mr. Arup Kumar Bhowmick ...for the petitioner Mr. Tapodip Gupta ...for the de facto Ms. Sukanya Bhattacharya Mr. Tirthankar Dhali ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. In any event, the petitioner is not the principal accused. There is a delay of about 45 days in lodging the FIR.
Learned counsel for the State opposes the prayer for anticipatory bail. She submits that the petitioner had earlier prayed for anticipatory bail before the Session Court in 2022. This is a case of extortion where the petitioner played an active part. There are statements of victim and local eye-witnesses to bear out the same. Considering the incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider that this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
