Roy ...for the SSC Ms. Koyeli Bhattacharyya Mr. Bibek Dutta Ms. Keya Panja ...for the WBBSE In terms of the order dated 14th January, 2025 a report in the form of affidavit is filed on behalf of District Inspector of Schools (SE) Nadia being respondent no. 3 and same is taken on record.

Husband of the petitioner was working as Clerk of Nabadwip Hindu School, Nadia, died-inharness on 18th March, 2017 and thereafter application was made by the petitioner for appointment on compassionate ground.

The aforesaid school authority vide letter dated 2nd November, 2017 forwarded all relevant documents to the respondent no. 3 for taking

decision on the application of the petitioner seeking appointment on compassionate ground.

Grievance of the petitioner is till date no decision has been taken by the respondent no. 3 thereby forwarding the proposal to the concerned Regional School Service Commission for granting appointment on compassionate ground.

Today, the learned advocate representing the State-respondents in reference to a document at page 29 of the report submits that a letter dated 24th July, 2024 was issued by the respondent no. 3 addressed to the petitioner for submission of certain documents. It is contended on behalf of the State-respondents that the respondent no. 3 could not take decision due to non submission of documents by the petitioner pursuant to this letter dated 24th July, 2024.

On perusal of this memo dated 24th July, 2024 issued by the respondent no. 3 it appears to be vague since in the letter what are other documents which are required to be submitted by the petitioner or the aforesaid school authority are not indicated. On the contrary far back on 2nd November, 2017 the school authority forwarded all necessary documents to the respondent no. 3 for taking decision relating to appointment of the petitioner on compassionate ground.

In view of aforesaid situation writ petition stands disposed of directing the respondent no. 3 to take decision on the application of the petitioner seeking appointment on compassionate ground by fortnight from the date of communication of the order.

While taking decision if any document is required to be submitted petitioner and the school authority shall be called upon by the respondent no. 3 for submission of additional documents.

The decision to be taken by the respondent no. 3 shall be communicated to the petitioner by 7 (seven) days thereafter.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
