Learned advocate for the petitioner submits that there has been no progress in the trial of the case and till date charge has not been framed in connection with Mandarmoni Coastal P. S. Case No. 28 of 2019 and three of the accused persons are in custody in connection with the instant case. Mr. Das, learned advocate appearing for the State has submitted a report. Let the report be kept with the record.

Having considered the time period which has elapsed in case of the accused persons in custody I direct that if the learned special court is satisfied regarding the execution of the proclamation and attachment then in that case it would split up the trial on 12th June, 2024 the next date fixed for hearing and fix date within a fortnight for consideration of charges. The learned court after consideration of charges if it is of the opinion that the trial of the case should proceed then in that case the court would fix a schedule consisting of four dates and fix such schedule once in a month for the purpose of the present case.

The Officer-in-Charge, Mandarmoni Coastal Police Station would cooperate in case any communication is made for execution of notice to the witnesses of the

instant case and ensure regarding the availability of the witnesses on the date so fixed for examination.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. The trial of the case should proceed in spite of any resolution of the local Bar and the participating advocates will not stall the proceedings in spite of such resolution.

All stake-holders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 3745 of 2023 is disposed of.
