The grievance of the petitioners is that respondent no. 8 is carrying out an unauthorised construction on Plot No. 363, Mouza-Molla Shimla, J.L. No. 95, Police Station-Singur, District Hooghly. The petitioners submit that respondent no. 8 is a co-sharer of the said land. However, without converting the classification of the land from "Bagan" to "Bastu" and without obtaining any sanctioned plan from the Panchayat Authority, respondent no. 8 has allegedly undertaken an unauthorised construction on the said plot.

No adjudication with regard to the right, title, or interest of the parties is required to be undertaken in the present writ petition.

Respondent no. 8 is unrepresented.

In the aforesaid circumstances, this writ petition is disposed of by directing the Pradhan, Nasibpur Gram Panchayat, Hooghly, to consider the representation of the petitioners appearing at page 22 of the writ petition and, if any unauthorised construction is detected, to take appropriate steps in accordance with Section 23(5) of the West Bengal Panchayat Act, 1973.

Let the aforesaid exercise be completed within a period of two weeks from the date of communication of this order.

Accordingly, WPA 23927 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
