This is an application for expeditious disposal of a suit at the instance of the defendant.

Learned advocate appearing for the petitioner submits that in spite of the fact that there is a previous direction passed by this Court for an expeditious hearing of the suit, there has been no substantial progress in the matter.

It appears from the record that a petition dated 17th April, 2023 was fixed for hearing on 22.11.2023.

On a query of the Court, learned Advocate appearing for the petitioner submits that the said substitution petition was filed upon the death of the plaintiff no.1.

He produces a copy of the order dated 10.01.2024, wherefrom it appears that the petition dated 17th April, 2023 was taken up for hearing on that date and the parties were heard at length and 26.02.2024 has been fixed for passing orders.

In view thereof, CO 3437 of 2023 is disposed of by requesting the learned Civil Judge (Junior Division), 3th Court, Paschim Medinipur to take up the hearing of the Suit after the disposal of the petition dated 17th April, 2023 and to make endeavour to dispose of the same as expeditiously as possible by keeping in mind the direction passed in CO 1577 of 2022.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
