The same was registered as GDE No. 1300 dt.

Earlier, orders passed by the Coordinate Bench reflect that there were some interactions between the petitioner

and the private respondent no.4. However, none of the parties have agreed to the proposal.

Report submitted by the State be kept with the record.

The report reflects that an agreement for sale was entered into, pursuant to which a sum of Rs. 7 lakh was paid. However, the rest of the money was not paid and the respondent no.4 is staying at the property of the petitioner after entering into the sale agreement.

The petitioner complains of inaction at the behest of the police authorities.

Having considered that the nature of the dispute has arisen out of an agreement for sale entered into by and between the parties and, a part of the money is paid, I am of the view that this Court cannot direct the police authorities

to take steps.

However, the petitioner will be at liberty to take appropriate steps before the learned jurisdictional court under Section 175(3) of the BNSS.

The learned Magistrate will take into account the report submitted by the police authorities and exercise his/her discretion in accordance with law.

With the aforesaid observations, WPA 23225 of 2023 is disposed of.

Report so submitted be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
