Learned senior advocate appearing for the petitioner submits that the petitioner is in custody since June 2025 and till date, charge-sheet has not been submitted before the jurisdictional court thereby warranting release of the petitioner on statutory bail.

State has submitted a report dated 06.11.2025 prepared by Deputy Superintendent of Police, Directorate of Economic Offences, Government of West Bengal. Let the same be kept with the record.

The said report reflects that till date, charge-sheet has not been submitted in connection with Mogra Police Station Case No. 167 of 2025 dated 11.04.2025.

Having considered the fact that the petitioner is detained beyond the statutory period and is entitled to default bail, I direct the learned Additional District & Sessions Judge, 3rd Court, Hooghly to accept the bond furnished on behalf of the petitioner. To that effect, petitioner will take out an appropriate application under Section 187 of the BNSS. Learned Special Court would allow the application and on furnishing of bond to the satisfaction of the learned Special Court, the petitioner may be released. Accordingly, the prayer for bail of the petitioner is allowed.

The application for bail, being CRM (M) 2146 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
