AD 97 November 14, 2025 Ct. 28 SG CRM(A) 3557 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Manikchak Police Station Case No.754 of 2024 dated 09.10.2024 under Sections 103(1)/238/61(2)/3(5) of the BNS, 2023.

Sk. Nayem @ Nayem Sk @ Nayem Sekh and another ... petitioners Mr. Arnab Chatterjee ... for the petitioners Ms. Amita Gaur Ms. Poulami Bose ... for the State Learned counsel for the petitioners submits that the FIR was lodged suo motu after two months of the alleged incident. It was stated there that two persons must be knowing about the incident. The petitioners are absolutely innocent and have not committed any offence.

Learned counsel for the State strongly opposes the prayer for anticipatory bail, relies on the case diary and submits that there are two eyewitnesses who had seen the occurrence. They had given statements before the police as well as the learned Magistrate. The call detail records also show that the present petitioners were at the place of occurrence at the relevant time.

Considering the above and the other materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
