Petitioner is aggrieved by the fact that his account has been frozen by the police authorities. Petitioner further submits that there has been a settlement with the de facto complainant. To that effect, documents have been enclosed particularly with regard to the communication made with the bank wherein the account was frozen on the basis of a communication made by a police officer pursuant to a General Diary Entry being recorded.

Learned advocate for the State submits a report. Report reflects that the investigation in respect of Purulia Cyber Crime Police Station Case No.12 of 2020 commenced and thereafter on conclusion of investigation, charge-sheet was submitted before the jurisdictional court.

Presently, the said case is pending before the learned Judicial Magistrate, 4th Court, Purulia. The contents in the writ petition are incomplete and devoid of particulars. However, since the main purpose of filing the present writ petition is for defreezing of account which is a subject matter of a criminal case and the criminal court is in seisin of the matter, petitioner is granted liberty to approach the learned Judicial Magistrate, 4th Court, Purulia with appropriate prayers.

With the aforesaid observations, WPA 24094 of 2024 is disposed of.

Report so submitted by the learned advocate for the State be kept with the record.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
