Mina for the State Ms. Deblina Chatterjee for the respondent no. 2 According to the petitioners a lease was granted in their favour for running a vessel for a period of two years. The petitioners submit that presently there is a provision for grant of lease for a period of five years. The petitioners are interested to run their vessel in the route in question and they have purchased a new vessel and want to avail the benefits under the Jaladhara Scheme. The petitioners submit that presently the panchayet authority is running the vessel themselves without granting any lease in favour of any person.
The petitioners by a representation dated 3rd July 2019 followed by a reminder dated 19th September 2019 made a request before the District Magistrate, North 24 Parganas with a prayer for extension of lease deed for a period of five years. The petitioners allege that their
representation is yet to be considered by the respondent authority.
As it appears that the representation praying for extension of lease is pending consideration at the end of the District Magistrate, North 24-Parganas, the Court thinks it fit to dispose of the writ petition by directing the respondent no. 3 being the District Magistrate, North 24Parganas to take a decision with regard to the prayer of the petitioners praying for extension of their lease for a period of five years, strictly in accordance with the relevant rules, within a period of four weeks from the date of communication of a copy of this order. The said respondent shall pass a reasoned order and communicate the same to the petitioners immediately thereafter.
The writ petition being WPA 21531 of 2019 and the connected application being IA No. 1 of 2020 are thus disposed of.
