State of West Bengal and another Mr. Prosenjit Mukherjee Mr. Saptarshi Chakraborty .. for the petitioner On prayer of the petitioner, liberty is granted to the petitioner to withdraw the revisional application and take necessary steps before the learned Additional District and Sessions Judge, Barrackpore.

In the event the petitioner files appropriate application before the learned Additional District and Sessions Judge, Barrackpore within two weeks from date, the learned revisional court shall deal with the application on merits and shall not dismiss it on the ground of limitation.

The order impugned dated 28th August, 2024 passed by the learned Judicial Magistrate, 3rd Court, Barrackpore in M. Case No.3 of 2023 be stayed for the period of two weeks from date. On prayer of the petitioner, liberty is granted to the petitioner to withdraw the certified copy of the documents filed herein, upon furnishing photocopies thereof.

The revisional application is dismissed as withdrawn. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Suvra Ghosh, J.)
