Mr. Robin Basu and Ms. Alotriya Mukherjee, learned advocates appear for the petitioner are present.

State was directed to produce the Case diary in connection with Baguihati Police Station Case No. 628 of 2013. None appears for the State.

Learned advocates for the petitioner submit that the petitioner expired on 15.5.2021. Accordingly, an appropriate order may be passed. This application was filed under Section 401 and 482 of the Cr.P.C. for quashing of proceeding in G.R. Case No. 4720 of 2013 under Section 323/447/326B/34 of the IPC wherein the petitioner was one of the accused person in the charge sheet.

Since the petitioner has expired, his application for quashing of the proceeding in respect of him is infructuous and the same is disposed of. Interim order, if any, stands vacated.

Let a copy of this order be communicated to learned Judicial Magistrate, 2nd Court, Barasat for information with the direction to proceed with the hearing in G.R. Case No. 4720 of 2013 in accordance with law.
