1. Learned counsel appearing on behalf of the petitioner submits that there is no incriminating material available against the present petitioner except for the statement of the co-accused.

2. Learned counsel appearing for the State files a report which is taken on record. She relies on the report and the case diary and opposes the prayer for anticipatory bail. She submits that other than the materials available in the case diary, the petitioner was in constant touch with the principal accused at the relevant point of time over phone.

3. Considering the above and the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
