Learned advocate for the State opposes the prayer for bail and submits that witness action has already been commenced.

Having considered the quantum of seizure, I am of the view that Section 37 of the NDPS Act is attracted, as such, I am not interested to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.

However, the trial court is directed to ensure that the seizure list witnesses are examined within a period of 60

days from the next date so fixed before the learned trial court.

The petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over. Accordingly, CRM(NDPS) 1347 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
