This is an application for a direction upon the learned court below to dispose of the application under Order XL Rule 1 of the Code of Civil Procedure within a specified time frame.

Mr. Banerjee, learned Advocate appearing for the petitioner submits that the said application is otherwise ready for hearing and the learned court below has fixed the date for hearing of such application sometimes in the month of February, 2024.

In view of the aforesaid submission of the learned Advocate for the petitioner, CO 3449 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), 4th Court, at Alipore to take up the hearing of the application under Order XL Rule 1 of the Code of Civil Procedure, if the same is otherwise ready for hearing, and to dispose of the same as expeditiously as possible but preferably within a period of four weeks from the next date fixed without

granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
