Mr. Sankha Subhra Ray Mr. Soumyajit Mukherjee........for petitioner Mr. Subhrangshu Panda......for KMC Mr. Ray, learned advocate appears on behalf of petitioner and submits, his client is before Court due to inaction on part of the Corporation to cause mutation of his name in respect of the premises. Mr. Panda, learned advocate appears on behalf of the Corporation and submits, recorded co-owner is missing since long. A declaration from civil Court of death is necessary. Mr. Ray responds that law has been declared by the Supreme Court that civil death certificate is not required for purposes of mutation. The Corporation will deal with the application on giving petitioner a hearing, for petitioner to satisfy queries of the Corporation in the matter. The mutation is to be effected within four weeks from date of communication of this order,
failing which, within that time the Corporation will make known to petitioner as to why it cannot be done.
Writ petition is disposed of.
