The State of West Bengal Mr. Sujoy Sarkar Ms. Sneha Srivastava ...for the Petitioner Mr. Suman De ...for the State The petitioner herein being aggrieved by the order dated 15.5.2025, preferred the instant application contending that the learned court below without giving any opportunity to the surety to produce the accused person before the court, has straightway issued warrant of arrest against the present petitioner. However, he made a very innocuous prayer before this court that the petitioner now wants to surrender before the court below and for which he seeks leave before this court. Mr. Suman De, who usually appears before this court on behalf of the State, is hereby appointed to represent the State. The concerned authority is directed to regularize his appointment. A copy of the application is handed over to Mr. De.

Having heard learned counsel for the petitioner and the State, the instant application being CRR 4468 of 2025 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of four weeks and in the event of such surrender by the petitioner, the court below will

dispose of his prayer in accordance with law without being influenced by any observations made herein.

The impugned order which was passed vide order dated 15.5.2025 by which the warrant of arrest was issued against the petitioner, is hereby stayed for a period of four weeks or till the petitioner surrenders before the Trial court, whichever is earlier.

All parties shall act on the basis of the server copy of this order, duly downloaded from the official website of this court.
